The following Terms and Conditions apply to the website www.balanceholidays.com (hereinafter, the “website”), operated by HEALING BREAKS Ltd (hereinafter, the “company”). HEALING BREAKS Ltd trades as Balance Holidays and is registered in England and Wales under Company No 11186291.

It is important that you read the following Terms and Conditions carefully as they are an integral part of your contract with HEALING BREAKS Ltd, together with the privacy policy and the booking confirmation. By making a booking on the website, you accept (also on behalf of the party named in your booking) the Terms and Conditions.

The person making the booking must be at least 18 years of age and authorised to do so by all persons named in the booking and the parent or guardian of all party members under the age of 18 years when the booking is made. The person making the booking is responsible for making all payments due to us and under the booking. All party members named within the booking are jointly and severally liable for all payments due under the booking.

These Terms & Conditions apply equally to UK bookings as well as the rest of the world bookings. Your contract will be governed by the laws of England and Wales and the courts of England shall have exclusive jurisdiction to deal with any disputes arising between you and the company or its suppliers.

You should not use this website if you have any objection to any of these terms and conditions.

HEALING BREAKS Ltd reserves the right to change the terms, conditions and notices under which this website is offered as appropriate and without prior notice. By using this website you are expected to review such Terms and Conditions before completing a booking.

1. Definitions

The following terms have specific meanings:

‘we’, ‘us’ and ‘our’ refers to HEALING BREAKS Ltd., the company as described above, incorporated under the Laws of England and Wales, whose registered office is in 12 Avenue Mansions, Sisters Avenue, London SW11 5SL United Kingdom. The company is registered under Company No 11186291 and operates through the website www.balanceholidays.com.

‘you’ or ‘your’ refers to you, on behalf of yourself and your guests or party, collectively, the customer, client, guest or party, potential or actual, of HEALING BREAKS Ltd. It also refers to any user of this website.

‘supplier’ refers to any of our independent contractors (hotels, properties, experts, etc). Note carefully that we act as intermediaries between you and our suppliers, as we bundle and tailor a programme that we sell exclusively through our website and offline channels.

‘website’ refers to www.balanceholidays.com.

‘wellbeing retreat’ or ‘programme’ refers to the product that can be purchased on our website, including accommodation, meals and activities.

‘property’ refers to the property where the wellbeing retreat is held.

‘expert’ refers to the skilled coach who will lead the wellbeing retreat, together with any guest experts.

‘booking’ refers to the booking of the wellbeing retreat and the process of purchasing the product via the website.

‘price’ refers to the price payable for the product booked.

‘deposit’ refers to a percentage (50%) of the full price of the product, to be paid to secure a booking.

'balance’ refers to the outstanding balance to be paid to purchase the secured product booking, after the deposit has been paid.

‘administration fee’ refers to a fee charged to cover costs incurred during the booking process.

‘cancellation’ refers to not attending the programme booked, including postponing or rescheduling it.

‘non-refundable’ refers to an amount paid by the customer that will be forfeited (unless clause 10 or 12 applies).

2. Prices and price changes

HEALING BREAKS Ltd is a British company and henceforth the primary currency is British Sterling Pounds (GBP). We also accept payments in United States Dollar (USD) and Euro (EUR).

Therefore, prices listed on HEALING BREAKS Ltd’s website are expressed in GBP (British Pound Sterling), USD (United States Dollar) and EUR (Euro). However, please note that at the time of booking, prices in United States Dollar (USD) and Euro (EUR) may be subject to adjustments due to exchange rate fluctuations.

The currency displayed depends on your geolocation. You can, however, toggle the currency settings by choosing the one you prefer to be displayed and make payments in, from the drop-down menu in the top right navigation bar.

Prices are based on the local net tariffs of the supplier at the time of quoting converted into GBP, USD and EUR at the prevailing foreign exchange rates.
All products offered by HEALING BREAKS Ltd are not subject to VAT.

The prices of fixed date wellbeing retreats refer to the price per person depending on the chosen accommodation and include what is stated in the "WHAT’S INCLUDED" section of the programme page.
The price per person expressed for a private wellbeing retreat is a "starting at" price and it will be confirmed by our team, only once all the activities and services to be included in the programme will be defined. You will therefore be redirected to an online enquiry form to start the booking process offline.

Unless otherwise specified, not included as part of the programme are the transport from and to the property, activities and spa treatments not listed under inclusions in the programme and all other items of a personal nature. In addition, comprehensive travel insurance, security, port charges, park fees, customs, immigration, agricultural, passenger facility charges and international transportation tax are not included.

You should arrange to pay for all of the above items directly and own sufficient local currency to do so.
HEALING BREAKS Ltd is not responsible nor liable for any independent travel arrangements (e.g. flights, visa or passport fees, airport parking, car hire, etc.) as they do not form part of our contract with you.

We reserve the right to amend prices at any time. After the full payment has been completed, the price of your product is confirmed and we will not apply any changes unless you request any amendments to the booking.

3. Registration and account set up

Once you have chosen the programme you would like to purchase, you need to register onto the website by creating an account with username and password. Once you are successfully registered you can start the booking and payment process.

4. Timing and payment methods

The 50% of the price of the programme booked is your non-refundable deposit and it is required at the time of booking to secure your place in a programme.

If a booking is made more than 56 days before the commencement of the programme, you can choose either to pay the full balance or just the non-refundable deposit (50% of the full price of the product). If you choose to proceed with the latter, the outstanding balance is due 56 days before the commencement day of the programme. A representative of our Customer Service will contact you a few days before the outstanding balance due date and remind you about all the instructions to settle the relevant payment. Should you not timely pay the outstanding balance when due, HEALING BREAKS Ltd reserves the right to cancel the booking in full and will not refund the deposit paid.

If a booking is made less than 56 days before the commencement day of the programme, the full balance is due immediately.

We want to make our trips accessible to as many people as possible, therefore we are open to set up payment plans. Please contact us for further information.

5. Booking confirmation

Upon receipt of your payment, our Customer Service team will contact you to confirm your order within 24 hours.

If a booking is made more than 56 days before the commencement of the programme, you will receive:

If a booking is made less than 56 days before the commencement day of the programme, you will receive an email confirming the details of the booked wellbeing retreat, the receipt of the full payment and the invoice for the full amount paid. This applies also to bookings made more than 56 days before the commencement day of the programme and paid in full.

Please check the confirmation carefully to make sure that all your booking details are correct. Contact us if your confirmation appears to be incorrect or incomplete and we will endeavour to make the necessary changes. HEALING BREAKS Ltd reserves the right to make changes after bookings have been confirmed. HEALING BREAKS Ltd cannot be held liable for errors and omissions you made during the booking, which are not notified promptly. The customer remains responsible for any additional costs or changes that occur as a result.

Within two weeks before the start of the programme we will share with you the Programme Schedule and Practical Information, which will contain the full itinerary and all relevant information about the wellbeing retreat.

 6. Referral and coupon code

If you have been referred and you have received a specific coupon code you can use it to redeem your reward:

Once your booking is confirmed, we will be in touch with you prior to the wellbeing retreat to discuss any arrangements for the delivery of the reward.

7. Changes made by you after booking but before travel

Should you request a change to your booking before travel, the prices applying to the new booking will be those prices applicable on the day the new booking is made. The change request must be made by the person who has made the initial booking.

Please note that an administration fee of £250 per booking will be applied in addition to any price differences paid.

8. Changes made by you after travel

No refunds can be issued once a wellbeing retreat has commenced.

9. Cancellation Policy or no show by you

You or any member of your party may cancel your booking at any time prior to the commencement of the programme providing that the cancellation is made by the person who originally booked and is notified to us in writing by emailing hello@balanceholidays.com.

Cancellation will take immediate effect from the day the notification is received by us.

Cancellation Charges:

Please note that your 50% deposit is non-refundable in all circumstances (unless clause 10 or 12 applies) as, with your cancellation, several costs incur on our end.

If you cancel more than 56 days before the commencement date of the wellbeing retreat, there is a chance that we might be able to move your deposit to another programme. This depends on waitlists and availability and is at our sole discretion. If we are able to transfer your deposit to another programme, an administration fee of £250 per booking applies in addition to any price differences paid.

In case of a no show by you, 100% of the payments will be forfeited.

By agreeing to these Terms and Conditions, you agree to pay all charges associated with cancellations made by yourself or with a no show.

10. Changes made by HEALING BREAKS Ltd

HEALING BREAKS Ltd reserves the right to change, substitute or cancel any activity of the programme and/or cancel the entire programme.

All fixed date wellbeing retreats shown on our website can only be operated if a minimum number of people book these programmes. Should there is insufficient demand on subsequent confirmed bookings, HEALING BREAKS Ltd reserves the right to cancel the programme in question.

The minimum number of participants for each Private and Corporate Wellbeing Retreat is subject to its corresponding enquiry.

HEALING BREAKS Ltd will promptly notify you of any significant changes or cancellations to your purchased product. If you do not wish to accept the change, where possible, we will offer you an alternative programme in the same price range at no extra cost, or a less expensive programme and a refund on the price difference. Alternatively, you can choose any other more expensive programme and pay a price difference. If you decide to cancel your booking, you will receive a full refund.

If the expert, as a result of an injury, illness, or personal emergency, cannot attend the wellbeing retreat and has to cancel his/her participation (including up to the commencement day of the programme), or has to leave the wellbeing retreat early, or cannot teach one or more of the activities during the wellbeing retreat, we will do everything possible to find a replacement expert.
If we cancel any activities during the wellbeing retreat as a result of this, we will not be liable to refund any activities to participants, however, we will do our best to make up for these activities during the course of the programme. We reserve the right to change the scheduled expert at any point in time and we are under no obligation to disclose the reason for the change. We reserve the right to change the times and schedule of the activities during the course of the wellbeing retreat as well as the location of the activities on site. Whenever possible you will be advised in advance of any changes. No refunds will be given due to a change of expert, changes to our schedule, or to the location of the activities.

11. Our liability to you

Although HEALING BREAKS Ltd makes every effort to ensure the fulfilment of the suppliers’ obligations, we act as an intermediary for the relevant supplier of any product booked and we have no liability of any kind to you or your party or dependents for any death, personal injury, illness, loss, consequential loss or damage of any kind you or your party or your dependents may suffer while undertaking any activity or treatment provided by the supplier.

If you have any complaints concerning any services provided by our suppliers you must notify us in writing via email within 3 days of the end of the wellbeing retreat. Any assistance provided in resolving a complaint raised is provided on a goodwill basis and in our capacity as an intermediary. It will always remain the responsibility of the supplier to agree and accept liability if appropriate and to provide any concession or refunds as they see fit and HEALING BREAKS Ltd cannot influence their decisions in this regard.

We will not accept responsibility for any services which do not form part of your contract with us. These may include any excursion purchased during the course of your holiday and any additional services or facilities which we have not agreed to arrange or provide as part of our contract with you.

If you have a complaint concerning the specific programmes provided by HEALING BREAKS Ltd, you must notify us immediately in writing via email within 3 days of the end of the wellbeing retreat and we will do our best to resolve the complaint.

12. Force majeure and circumstances beyond the control of HEALING BREAKS Ltd and its suppliers

HEALING BREAKS Ltd and its suppliers shall not be held liable for damages for any delay, defaults or non-performance of any of the terms or obligations arising out of any cause or causes beyond its reasonable control and occurring without its fault or negligence (“Force Majeure Acts”). A circumstance beyond control is one that cannot be foreseen or avoided, even after taking all due care and includes, but is not limited to, war, threat of war, riots, civil disturbances, terrorist activity and its consequences, industrial disputes, any failure to secure flying rights, natural and nuclear disaster, fire, epidemics, health risks and pandemics and unavoidable and unforeseeable technical problems with transport reasons beyond the party’s control, closed or congested airports or ports, hurricanes and other actual or potential severe weather conditions, and any other similar events.
In such circumstances, THE COMPANY will offer you a voucher that you can use to book a future wellbeing retreat of your choice. Alternatively, you will be offered a full refund.

13. Health and travel insurance

We strongly recommend purchasing suitable and comprehensive health and travel insurance to cover you and your party before, during and after your trip as neither HEALING BREAKS Ltd nor its suppliers can be held responsible for any costs incurred by you or any member of your party before, during or after your trip as a consequence of inappropriate or insufficient health and travel insurance being purchased.

You can buy your travel insurance from any insurance provider of your choice. We are not in any way qualified to recommend a particular travel insurance provider as HEALING BREAKS Ltd does not sell nor supply insurance or insurance-related products and we reckon that the insurance you choose depends widely on your specific requirements. Please contact us if you need any additional information on this matter.

You acknowledge and accept that the purchase of comprehensive travel insurance is your only way to recover any non-refundable payments made to HEALING BREAKS Ltd and any other expenses incurred by you.

14. Passports/Visas and health requirements

It is your responsibility to check with the relevant embassies and/or consulates the passport and visa requirements for yourself and your party, together with any other immigration requirements prior to travel. We do not accept any responsibility if you cannot travel if you have not complied with the relevant requirements in force prior to and at the time of travel.

It is also your responsibility to check all compulsory and recommended health requirements prior to travel, including vaccinations, and to ensure that you and your party have any necessary vaccination certificates and health documentation. The costs of obtaining any such documentation are your responsibility and we are unable to accept any responsibility or liability if your travel arrangements are affected as a result of the failure to do so by yourself or any member of your party.
Health requirements may include a certificate or document certifying vaccination against COVID-19, a negative certificate of a SARSCoV2 Diagnostic Test, a certificate of recovery from COVID-19, travel health forms and temperature checks.

At the time of your booking, you must provide us with full details of any existing medical condition or disability that may affect your participation in the booked programme (including any accommodation requirements). If in our opinion your chosen wellbeing retreat is not suitable for your medical problem or disability, or you are not travelling with someone who can provide all assistance you may reasonably require, we reserve the right to refuse your booking and we will refund you the full payment.
Failure to inform us about the above might result in denied participation in the programme activities.

15. Health and safety

Our carefully selected experts will respect your personal decisions and allow you to make your own choices about what exercise you wish to carry out. We ask you not to exercise beyond what you consider to be your own abilities and limits, as well as to promptly inform the expert about any special requirements or circumstances.?
We will make every reasonable e?ort to make sure that any provided equipment and facilities are in a safe condition for you to use and enjoy.

The health and safety standards that apply to the programmes provided meet the standards applicable to the booked destinations, and HEALING BREAKS Ltd ensures that those local standards have been met.

COVID-19 specific rules

All suppliers we work with follow the WHO and the CDC (Centres for Disease Control and Prevention) recommendations in relation to COVID-19 rules.

We kindly ask all guests to behave responsibly and maintain social distance when moving around the property and the estate.

For the safety of other customers, the property staff and HEALING BREAKS Ltd team, all customers must respect all COVID-19 protocols of the destination country.

HEALING BREAKS Ltd nor its suppliers can be held responsible for any expenses or losses incurred by you during the self-isolation period.

16. Special requests and medical problems

If you have a special request, dietary requirements, relevant and / or existing medical conditions, or disability, please notify us at the time of booking. We will strive to accommodate any special needs. However, we cannot guarantee that the request will be met and any failure to do so will not be a breach of contract on our part. Proof that a request has been made will be included in your booking confirmation email or upon the acknowledgement of the booking. We are unable to accept bookings which are conditional upon a special request being met and these will be treated by us as a standard booking.
We strongly recommend to remind our representatives/property representatives of any requirements upon arrival at the property.

We do not advertise, advocate nor imply that our programmes or any activity and SPA treatments included in our programmes are a substitute for professional medical care or treatment. Should you have any concerns about the impact of any of these on your physical or mental health, please consult a doctor before booking.

No refunds of any nature will be provided in the instance an activity must be cancelled for any health reason.

17. Activities and Spa Treatment times

HEALING BREAKS Ltd reserves the right to change the times of activities because of unforeseen circumstances (i.e. adverse weather conditions or similar reasons). These changes would not constitute an entitlement to a refund or to a cancellation.

Spa treatments or activities booked by you during your stay and not included in the product booked with HEALING BREAKS Ltd must be arranged and paid directly to the supplier.

18. Your behaviour and your responsibilities

Throughout your booking with HEALING BREAKS Ltd, you are accepting liability for any loss or damage caused by you or any member of your party during the course of your wellbeing retreat. Payment for any loss or damage must be made to us or to our supplier at the time that it occurs or as soon as is reasonably practicable thereafter. You will also be responsible for and agree to indemnify us, in respect of any claim subsequently made against us and all costs incurred by us (including our own and any other party’s full legal costs) arising from your actions.

You are also responsible for the behaviour of yourself and other members of your party. We can refuse to accept you as a customer or refuse to continue dealing with you and/or any other member of your party by terminating your participation in the programme if your or their behaviour is or is likely to be, in our or our suppliers' reasonable opinion, disruptive, upsetting or dangerous to yourself or anyone else, or if you or any member of your party have caused or are likely to cause damage to the property. In these circumstances, all the payments made by you will be forfeited.

19. Dress code

You must always comply with the hotel and spa etiquette to access and enjoy the facilities. HEALING BREAKS Ltd can take no accountability in case you forget to pack any necessary or suggested items to attend the activities included in the booked product.

20. Additional booking information

All bookings will be subject to the property’s own rules. Please make sure you read them on arrival.

Unless otherwise stated, activities are restricted to over 18s only.

21. Children Policy

HEALING BREAKS Ltd is child-friendly and offers family programmes that include activities for children.

Depending on activities involved in the programme and the specific property terms and conditions, please note there could be a minimum age requirement.

A participant who is less than 18 years old, must be accompanied by an adult who can represent, warrant, authorise, and sign on behalf of the minor participant. The accompanying adult is responsible for the minor’s actions, misadventures, injuries or for any other events not listed here.
The charge for children will vary depending on the programme details.

22. Pet Policy

If you wish to bring your pet with you please contact us and we will check the pet policy of the property for you.

23. Information Accuracy

HEALING BREAKS Ltd has no responsibility for the verbal information provided to you by our suppliers before, during or after your booking. This also applies to the written content they share on their website and social media pages and to their terms and conditions as we have no direct control on these.

HEALING BREAK Ltd is not responsible for the content or terms and conditions of other websites to which this website may link.

24. If you have a complaint

Complaints must be notified in writing by emailing hello@balanceholidays.com within 3 days of the end of the wellbeing retreat.

25. Collection and use of your personal information

Please refer to our privacy policy which forms an integral part of these website booking terms and conditions.

26. Your use of the website

You are solely responsible and liable for all activities on the website. You shall not submit on the website and on social media pages linked to the website any review, comment, link or other material whatsoever that may reasonably be deemed to be offensive, illegal, inappropriate or in any way promote racism, bigotry, hatred or physical harm of any kind against any group or individual; harass or advocate harassment of another person; promote any conduct that is abusive, threatening, obscene, defamatory or libellous; promote any illegal activities; promote or contain information that you know or believe to be inaccurate, false or misleading; infringe any rights of any third party.
